These Terms of Service (“Terms”) govern your access to and use of the websites, mobile experiences, and online storefronts operated by Amino Pharm LLC (“Amino Pharm,” “we,” “us,” or “our”), including any content, functionality, and services offered on or through aminopharm.com (collectively, the “Site”).
By accessing or using the Site, creating an account, or making a purchase, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. You represent and warrant that you have the legal capacity to enter into these Terms.
You may need an account to access certain features. Keep your credentials confidential and notify us immediately of any unauthorized use. You are responsible for all activity under your account.
Orders. All orders are offers to purchase products and are subject to acceptance by us. We may refuse or cancel any order for any reason.
Pricing & availability. Prices, discounts, and promotions are subject to change without notice. Product availability may be limited.
Payment. We accept the payment methods shown at checkout. You authorize us and our payment processors to charge your selected payment method for the total order amount, including taxes, shipping, and applicable fees. We do not store complete payment card details.
Taxes. You are responsible for any applicable sales, use, VAT, or other taxes.
Fraud prevention. We may require additional verification or information before accepting any order.
We ship to the destinations listed at checkout. Risk of loss and title pass to you upon our delivery to the carrier. Delivery dates are estimates and not guaranteed.

If you submit reviews, comments, or other content, you grant Amino Pharm a worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such content in connection with the Site and our business. You represent you have all rights necessary to grant this license and that your content complies with these Terms.
We may link to third-party websites or use third-party tools (e.g., analytics, payment processing, marketing platforms). We are not responsible for third-party sites or services; their terms and privacy policies govern your use of them.
Promotions, coupons, and subscriptions are subject to additional terms disclosed at the point of offer or enrollment. We may modify or discontinue promotions at any time.

Mobile Terms of Service

The Amino Pharm mobile message service (the “Service”) is operated by Amino Pharm LLC (“Amino Pharm”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Amino Pharm’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Amino Pharm through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Amino Pharm. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +1 (844) 912-5316 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Amino Pharm mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Abandoned Cart Disclosure (also referenced in our Privacy Policy): Our website uses cookies and/or plugins to determine when a cart has been abandoned. This information may be used to send cart-reminder messages via SMS where you have consented to receive them.
THE SITE, PRODUCTS, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMINO PHARM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AMINO PHARM, ITS AFFILIATES, OR THEIR LICENSORS, SUPPLIERS, OR PERSONNEL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO AMINO PHARM FOR THE PRODUCT(S) OR SERVICE(S) GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE EVENT.
Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless Amino Pharm and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Utah, without regard to conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Utah for any dispute not subject to arbitration (if applicable).
We may update these Terms from time to time. Changes are effective when posted on the Site with an updated “Last updated” date. Your continued use of the Site constitutes acceptance of the revised Terms.
